DarkHorse.Codes complies with the Digital Millennium Copyright Act (DMCA). This page explains how to submit a copyright infringement notice, how we process those notices, and how affected subscribers can file a counter-notification.

What you should know first


§1 — Designated Agent

§2 — How to Submit a Notice

Email dmca@darkhorse.codes with subject line: DMCA Takedown Notice — [Brief Description]

Your notice must include all of the following to be valid under 17 U.S.C. § 512(c)(3)(A):

(a) A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

(b) Identification of the copyrighted work claimed to have been infringed. (If multiple works at a single online site are covered by a single notification, a representative list of such works at that site is acceptable.)

(c) Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to permit us to locate the material — URL, title, episode, season, file identifier, or other locator.

(d) Information reasonably sufficient to permit us to contact you: address, telephone number, and, if available, an electronic mail address.

(e) A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

(f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices missing any element above may not trigger our obligations under § 512. We will still review them in good faith but cannot guarantee the same response timing or procedure.

§3 — What Happens When We Receive a Valid Notice

Upon receipt of a valid notice:

  1. We confirm receipt within 24 hours by automated reply
  2. We remove or disable access to the specifically identified material — typically within minutes via our automated DMCA processing system, never more than 24 hours
  3. We notify the affected Subscriber (if any) by email, providing a copy of the notice
  4. We log the action in our DMCA records, retained for at least three years
  5. We block re-acquisition of the specifically identified file or release source

Important note on scope of removal: Removal of a specific file or release source does not automatically prevent the affected Subscriber from requesting alternative copies of the same work through normal operation of the Service. Each alternative copy that is subsequently noticed will be processed independently. After three valid notices for the same work, that work as a whole is subject to permanent block (see §5).

§4 — Counter-Notification

If you believe material was removed in error or as a result of misidentification, you may submit a counter-notification.

Your counter-notification must include all of the following under 17 U.S.C. § 512(g)(3):

(a) Your physical or electronic signature.

(b) Identification of the material that was removed and the location at which the material appeared before it was removed.

(c) A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

(d) Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which DarkHorse may be found, and that you will accept service of process from the person who provided the original notification or an agent of that person.

Counter-Notification Process

  1. We confirm receipt within 24 hours
  2. We forward your counter-notification to the original complainant
  3. We wait 10 to 14 business days from the date of forwarding
  4. If the original complainant does not file a lawsuit seeking a court order against you within that window, we may restore the material
  5. If the original complainant does file a lawsuit, we maintain the takedown until court resolution

§5 — Repeat Infringer Policy

Under 17 U.S.C. § 512(i), service providers must adopt and reasonably implement a policy of terminating Subscribers who are repeat infringers.

§6 — Penalty for Fraudulent Notices

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing (or that material was removed by mistake) may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, or by DarkHorse.

We take fraudulent notices seriously and may pursue legal remedies against complainants who submit them.

§7 — What This Policy Is Not

This Policy is not legal advice. It describes our procedure for handling notices under federal copyright law. If you are uncertain about your rights, consult an attorney.

This Policy does not address claims under other intellectual property regimes (trademark, patent, trade secret). For those, contact legal@darkhorse.codes.

§8 — Modifications to This Policy

We may update this Policy. Material updates are announced via the registered agent email and posted with an updated effective date and version number. Prior versions are preserved in our public git repository.

§9 — Other Inquiries

For questions about this Policy that are not formal takedown notices, contact legal@darkhorse.codes. The dmca@darkhorse.codes address is reserved for formal notices and automated processing — general inquiries sent there may not receive prompt response.
